Resignation is the act of voluntarily dissociating himself/herself from the company for
his/her own personal reasons.
In this case, employees must:
- Provide the employer a 30-day notice prior to the effective date of his resignation.
- Submit a resignation letter expressing his intention to terminate the contract.
Reminders:
- The employer/client may not decline the employee's resignation but they may hold
the employee liable for damages if he/she is unable to provide the employer a 30-
day notice.
Note: Burden of proof lies on the employer to prove the damage caused by the employee's non-compliance
to the 30-day notice.
- The employer/client has the option to allow the employee to leave in less than 30
days.
- Should the employer decline the employee’s resignation, he/she may file a case of
involuntary servitude.
